General Terms and Conditions of Use

Browsing and using https://mgechternach.lu/ (the “Site”), as well as accessing the content and services available on the Site (the “Content”) by any adult individual or their legal representative (the “User”), is subject to Luxembourg law and regulations and to these Terms of Use (the “Terms”).

The MG Echternach group practice, hereinafter referred to as “MGE,” holds the exclusive ownership of the Site and its Content. MGE is a single-disciplinary group of general practitioners practicing medicine at the following address: 5, Place du Marché, L-6460 Echternach.

The following doctors practice at MGE:

  • Dr. Philippe Hoffmann
  • Dr. Daniel Lampach
  • Dr. Anne-Catherine Vervoort

The general practitioners are partners and share a digital patient file and a common secretarial office.

Access to and use of the MGE Site and its Content implies full and unconditional acceptance of the Terms by the User. By continuing to browse the Site, the User acknowledges having read and understood the entirety of the Terms and agrees to comply fully, under penalty of sanction. If the User does not wish to accept the Terms, they must stop accessing and/or using the Site.

MGE reserves the right to modify these Terms at any time and for any reason without prior notice to the User. Users are therefore advised to regularly consult the Terms to stay informed of any updates.

1. PURPOSE OF THE SITE

The Site is intended to present the MGE medical team and services. The descriptions on the Site are subject to change and are provided for informational purposes only.

The Site allows any User to request a prescription renewal online, subject to the conditions outlined in Article 8 of the Terms.

To access these services, the User must fill out the required information in the provided form. More information on how personal data is processed in connection with these services is available in the Privacy Policy, accessible via the following link: Privacy Policy or at the bottom of the Site. MGE expressly invites the User to consult the Privacy Policy, as it is an integral part of the Terms.

2. DISCLAIMER

MGE and its physicians shall not be held liable for any direct or indirect damages suffered by the User due to the use of the Site and/or its Content, a breach of the Terms, the actions of third parties, or an event beyond their control, such as force majeure.

MGE informs the User that access to part or all of the Site and/or its Content may be restricted for certain individuals or in certain countries, and MGE cannot guarantee compliance with foreign laws. It is the User’s responsibility to ensure they are authorized to access the Site and the Content.

2.1 Site Content

Although MGE strives to provide accurate and reliable Content, neither MGE nor the Site’s contributors can guarantee the completeness, accuracy, timeliness, quality, or precision of the Content. In particular, MGE cannot ensure that no unauthorized alterations have been made (e.g., viruses, intrusions).

MGE and its contributors disclaim all liability (direct or indirect) in the event of delays, errors, or omissions in the Content or in any use of the Content.

MGE expressly reserves the right to modify, add to, or delete all or part of the Content without prior notice or to suspend its publication, temporarily or permanently.

2.2 References and Hyperlinks

The Site includes third-party services and hyperlinks to other websites not published by MGE but which may be useful to the User or necessary for the Site’s operation and/or MGE’s activities.

MGE declares that, at the time the hyperlinks were created, no illegal content was identified on the linked pages. MGE has no influence on the current or future layout, content, or ownership of the linked pages.

Therefore, MGE cannot be held liable for the content found or referenced on these external websites, including its legality or accuracy.

2.3 Site Usage

MGE uses all available means to ensure the security of its IT system, including availability, integrity, and confidentiality. Since MGE is only bound by a best-effort obligation in this regard, the User cannot claim damages in the event of a malfunction, cyberattack, or total or partial unavailability of the Site.

Using any internet network involves risks in terms of reliability, data transmission security, access continuity, data transmission speed and volume, and virus propagation. MGE therefore recommends implementing specific and appropriate security measures to mitigate these risks. It is the User’s responsibility to acquire, operate, and maintain the necessary hardware, software, and equipment to access the Site.

Access to the Site is free of charge, except for internet connection fees borne by the User. MGE and its contributors strive to ensure the Site’s accessibility and availability as much as possible but assume no responsibility for this, particularly in the case of maintenance, updates, force majeure, third-party intervention, system failures, or internet-related issues.

2.4 Content Usage

The services available on the MGE Site are strictly reserved for adults and legal representatives of minors or protected adults. If a minor or protected adult uses a service on the MGE Site without obtaining prior authorization from their legal representative, MGE declines all liability.

The User agrees to use MGE services solely for their personal use. Exceptionally, they may use the services on behalf of a person for whom they are the legal representative by law or court decision. MGE informs the User that any misuse of the services or use inconsistent with the purposes described in the Terms, as well as any violation of privacy or medical confidentiality, may lead to sanctions, including criminal penalties.

3. PERSONAL DATA PROTECTION

As the data controller, MGE processes personal data collected via the Site in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) 2016/679 of April 27, 2016, and the Luxembourg law of August 1, 2018, on the organization of the National Commission for Data Protection and the general data protection regime.

To benefit from MGE’s services, the User agrees to provide accurate, complete, and up-to-date personal data (first name, last name, national ID, email address, phone number, health information, etc.). MGE cannot be held responsible for any consequences resulting from the User’s failure to do so. Using a false identity or providing false information may lead to civil and/or criminal prosecution.

If the personal data belongs to a third party, the User must have obtained the third party’s prior consent to share their data with MGE and informed them of the MGE Privacy Policy. The User expressly guarantees MGE against any claims or actions by third parties related to the personal data submitted via the Site.

4. INTELLECTUAL PROPERTY RIGHTS

The entire Site is protected by intellectual property rights, including copyright, under applicable laws. This protection covers both the structure (layout, data access methods, data organization, etc.) and each element of the content (texts, images, graphics, etc.). The Site and all its Content are the exclusive property of MGE. However, some content elements may be owned by their respective authors.

Any reproduction, distribution, broadcast, or redistribution of the Site and/or its Content, in whole or in part, by any means and on any medium, is prohibited without MGE’s express written authorization. This includes selling, reselling, sharing, retransmitting, publishing, or otherwise making the Content available to third parties. Non-compliance with this prohibition constitutes infringement and may result in civil and/or criminal liability.

5. SUSPENSION OR TERMINATION OF THE SITE

MGE reserves the right to suspend or terminate the Site and/or access to its Content at any time and for any reason without notice, including for maintenance or due to force majeure.

MGE also reserves the right to suspend or terminate a User’s access to the Site and its Content at any time without notice in the event of inappropriate behavior (legal violations, breaches of morality, etc.) or a violation of the Terms, especially in cases of actual or suspected breaches of MGE’s information system security.

6. GENERAL PROVISIONS

If certain parts or terms of the Terms of Use no longer comply or do not fully comply with the applicable legal provisions, the content and validity of the other parts shall not be affected.

Likewise, if any provision of the Terms is deemed by a competent court to be null, void, unenforceable, irrelevant, or inapplicable, that provision shall be considered inapplicable and shall not affect the validity or enforcement of the other provisions of the Terms as a whole.

The fact that MGE does not exercise one of its rights or does not require the performance of an obligation or responsibility of the User or a third party shall not be interpreted as a waiver of its rights.

7. CONDITIONS FOR MAKING APPOINTMENTS BY PHONE

The Site allows the User to make an appointment by phone during the secretariat's opening hours. Each time an appointment is made by phone, the User must provide accurate, complete, and up-to-date personal data (first name, last name, national ID, email address, phone number, health-related information, etc.) as well as the desired date and time of the appointment.

Requesting an appointment constitutes a firm commitment by the User. In the event of being unable to attend, the User agrees to notify MGE and cancel the appointment at least 24 hours in advance by phone. In the event of delay, the User also agrees to inform MGE, which reserves the right to cancel the appointment without providing justification.

Any requested appointment that is missed and not canceled will be invoiced to the patient, and the invoice cannot be submitted to the CNS (National Health Fund).

8. CONDITIONS FOR USING THE ONLINE PRESCRIPTION RENEWAL SERVICE

This article governs the relationship between MGE and the Patient in the context of the online prescription renewal service. A “Patient” is defined as any User who has previously consulted one of MGE’s treating physicians: Dr. Philippe Hoffmann, Dr. Daniel Lampach, or Dr. Anne-Catherine Vervoort (hereinafter “Physician”).

MGE informs the Patient that any online prescription renewal request does not constitute an obligation for MGE to approve it, which the Patient explicitly acknowledges and accepts.

Processing a Patient's request and renewing a prescription by MGE requires a minimum of twenty-four (24) working hours. This delay must be taken into account by the Patient when making an online renewal request. MGE and its physicians shall not be held liable for any damages caused by an interruption in treatment resulting from a late request or refusal to renew a prescription.

To be considered by MGE, an online prescription renewal request must meet all of the following criteria:

  • The Patient’s Physician must be one of the physicians currently practicing at MGE at the time of the request.
  • The medication to be renewed must have been prescribed for the treatment of a chronic condition during a prior individual consultation within the last six (6) months. Exceptionally, the Physician may authorize renewal for medication prescribed for other conditions if deemed appropriate.
  • The Patient must have been properly informed of the medication’s dosage when the initial prescription was issued and agrees to contact a physician immediately or book an appointment at MGE in case of doubt.

MGE also informs the Patient that, even when all conditions are met, renewal may still be denied. The Patient expressly agrees that:

  • If the Physician agrees to renew the prescription, they may modify it based on information provided by the Patient to reflect possible changes in the Patient’s health.
  • If the Physician doubts the Patient’s understanding or knowledge of the medication's dosage, the renewal request may be denied.
  • The Physician always retains the final decision regarding the renewal of any prescription and may, without justification and without any compensation owed to the Patient, request a follow-up consultation or refuse the renewal altogether.

Since many medications require regular in-person monitoring, teleconsultation or other remote methods cannot continuously substitute for physical consultations with the Physician.

Additionally, to renew a sick leave certificate, an in-person consultation is mandatory.

Any accepted prescription renewal by MGE is subject to a fee, and an invoice will be issued at the same time as the prescription. If postal delivery is requested by the Patient, postal fees will also apply.

9. TELECONSULTATION

MGE uses teleconsultation, allowing its Physicians to consult remotely using information and communication technologies.

The Physician will always decide whether teleconsultation is appropriate and may refuse it without justification and without any compensation owed to the Patient.

To book a teleconsultation, the Patient must have had an in-person consultation within the twelve (12) months preceding the request. However, to avoid unnecessary travel, the Physician may allow a teleconsultation even if this condition is not met, if deemed necessary.

Teleconsultation services provided by MGE are subject to a fee, and an invoice will be sent by post after the consultation.

Note: According to the CNS (National Health Fund), the special teleconsultation measures implemented during the SARS-CoV-2 pandemic expired on June 30, 2024 (announcement of 02.07.2024, last modified 05.11.2024).

10. INTERPRETATION

These Terms are written in French and translated into other languages for information purposes only. In the event of any dispute, the French version shall prevail over any other language version.

11. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Luxembourg law, even if the User is a foreign national.

In case of any dispute between the User and MGE regarding the validity, performance, or interpretation of the Terms, or any dispute related to browsing and/or use of the Site and/or its Content, both parties agree to cooperate in good faith and promptly seek an amicable resolution.

If no agreement is reached, the dispute falls under the exclusive jurisdiction of the competent courts of the Grand Duchy of Luxembourg.
